Subject: Club Tax Status
Everyone:
I spent some time with a local CPA who has experience working with clubs to
straighten out various issues.
I told him our story and showed him
documentation on the work done in the past, to either establish our charter
with the State of Texas back in 1999 or so, and the IRS form completed, but
not submitted, to request tax exempt status.
At the end of the discussion he
recommended two options for us to pursue. One: file a normal corporation tax
return this
year with our existing Tax ID number, maybe bake in as much
financial information covering the years since 1999, to
try to be as up
front as possible with our receipts and such. Maybe this will trigger a red
flag with the IRS and we will
be audited and then fined for not filing a
return in the years following the opening of the charter. There are various
r
isks with this option. One thing to remember is that our state Charter has
gone dormant. So, we no longer own the name
Bull Terrier Club of Dallas,
Inc. More than likely no one else has purchased the right to that name
either, so we can
probably get it back intact. This will have to be done
regardless of which path we pursue. Or, start fresh altogether.
Register
fresh the Club charter with the state, get a new Tax ID. And file our first
return in 2008. Actually, this start
fresh approach is preferred by the CPA.
Walt and I discussed it as well and we favor this approach as well. This
CPA
is willing to work with us to get this done, handle it entirely, or help us
complete forms and get them submitted.
